Terms of Service
Effective 14 August 2026
These terms are the agreement between you and CRM Niche for use of the service at www.crmniche.com. By creating an account you accept them. If you are accepting on behalf of a business, you confirm you are allowed to bind that business.
1. Who may use CRM Niche
You must be at least 18 years old to create an account. CRM Niche is business software and is not designed, marketed, or intended for children. We do not knowingly allow anyone under 18 to register, and we will close an account if we learn the holder is under 18.
You may not use the service if you are barred from doing so under the laws of your country, or if you are on a sanctions list that applies to us.
2. Your account
- Keep your password private. You are responsible for what happens under your account until you tell us it has been compromised.
- Give us an email address you actually control. We use it for confirmations, password resets, and notices about the service.
- One person, one login. Do not share a single login between several people. Invite them as members instead.
3. Workspaces and billing
A workspace holds one business. Each workspace has its own plan and its own bill. If you run three businesses in three workspaces, that is three subscriptions.
- Free trial. Your first workspace starts with 14 days of the Pro plan at no cost and without a card. The trial is granted once per account, not once per workspace.
- When a trial ends the workspace moves to the Free plan. Nothing is deleted. Anything above the Free limits is paused rather than removed, and you choose what stays active.
- Paid plans renew automatically each month until you cancel. Prices are shown before you pay.
- Cancelling takes effect at the end of the period you have already paid for. You keep access until then.
- Changing plan mid-period adjusts your next invoice for the difference.
- Taxes. Prices exclude any sales tax, VAT, or GST that applies where you are. Where we are required to collect it, it is added at checkout.
Payments are handled by Stripe. We never see or store your full card number.
4. Refunds
Monthly charges already taken are not refundable, except where a refund is required by the law that applies to you. Consumer protection law in some countries gives you rights we cannot exclude, including cooling-off periods, and nothing here limits those rights. If you were charged because something on our side went wrong, write to support@crmniche.com and we will put it right.
5. Your data stays yours
The records you put into CRM Niche - your customers, jobs, notes, files - belong to you. We do not sell them, we do not use them to train AI models, and we do not use them to advertise to anyone.
We process that data only to run the service for you. How we handle it is set out in the Privacy Policy, and if you are a business in the UK, EU, or anywhere with comparable law, the Data Processing Addendum forms part of this agreement.
You can export your contacts and work records to CSV at any time from Settings, including while your account is on the Free plan.
6. What you are responsible for
You decide what personal information you collect from your own customers and put into your workspace. That makes you the data controller for it and us the processor. In plain terms: you must have the right to hold that information, and to send it to any service you connect.
You agree not to use CRM Niche to:
- break the law, or help anyone else break it;
- store special category data such as health records, biometric data, or government identity numbers, unless you have a lawful basis and have told the people concerned;
- send unsolicited bulk messages, or harvest contacts you have no relationship with;
- upload malware, attempt to break the service, probe other customers' workspaces, or bypass plan limits;
- resell or white-label the service without our written agreement.
7. Public forms
Forms you publish are reachable by anyone with the link, which is the point of them. You are responsible for what you ask for on a form and for telling the people who fill it in how you will use their answers.
8. Connected services
You may connect CRM Niche to services we do not control, such as Slack, Discord, Telegram, Google Calendar, or an automation tool through a webhook. When you do, you are instructing us to send data to that service. What happens to it there is governed by that service's own terms, not ours. You are responsible for the accounts you connect and for any fees those services charge.
9. Availability and changes
We work to keep the service running, but we do not promise it will never be unavailable. We may change or remove features. If we make a change that materially reduces what you are paying for, we will tell you by email before it takes effect and you may cancel.
10. Suspension and termination
We may suspend a workspace if it is being used in a way that breaks these terms, puts other customers at risk, or leaves an invoice unpaid. Where the situation allows it we will contact you first. You can close your account at any time by deleting your workspaces.
After deletion. Deleting a workspace removes its records from the live database immediately. Encrypted backups roll off within 30 days, after which the data is gone and cannot be recovered. Export anything you want to keep before you delete.
11. Liability
CRM Niche is provided as it is. To the extent the law allows, we exclude implied warranties, and our total liability to you for any claim is limited to what you paid us in the twelve months before the claim arose. We are not liable for lost profits, lost business, or lost data beyond that amount.
Nothing here excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, for fraud, or for rights that consumer law gives you and does not permit us to remove.
12. Changes to these terms
We may update these terms. If a change is material we will email account holders at least 14 days before it takes effect. Continuing to use the service after that date means you accept the new version. The version you accepted is recorded against your account.
13. Governing law
These terms are governed by the laws of the State of Delaware, United States, and the courts there have jurisdiction. If you are a consumer, this does not take away the protection of the mandatory laws of the country you live in, and you may bring a claim in your local courts.
